Sympathy not wanted, assistance required! --------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------- I am writing this post today to try to understand the realm of this life I am required to live. If you have read any of my earlier blogs, my TBI does not affect my knowledge and intelligence, only my short term memory, not my long term. My logical thoughts and knowledge of reading law and state statutes concerning divorce laws, child support laws, just as I can repair any computer, I also can comprehend the laws, I have been studying them for 10 years, and for 10 years I have been discriminated by the courts and state child support case workers. This has been allowed to happen because of 2 negligent law firms. These two firms made such a disaster of my divorce, to the point of not even telling the courts I was 100% disabled father with decreased earning ability! I was ordered to pay more child support per month than I earned per month. When I hired a firm to straighten out the first lawyers negligence, they also took advantage of my disability, and addressed no child support issues, and tried to have me settle the open divorce case without even including the court stated interest that I was entitled to. After paying this lawyer for 2 years or more, I found out my ex-wife did not even have a lawyer!! She did not need one! My lawyers are buisness friends of her big brother, a prominent business man in that town. The way my life has turned out is proof of legal negligence, besides having proof in writing of legal negligence by my lawyers own hand in correspondences with my ex-wife. I have documentation proving the legal negligence, besides the fact the life I am forced to live to this day is proof alone! I had over $100,000.00 of equity from MY disability settlement and the courts gave all of it to her! These negligent lawyers allowed it! The divorce took place in a 50/50 state. I also know the laws that state definitions concerning property brought to the marriage. ================================================================================================================================================================================================================================================================ What good are having laws on the books that are there to protect disabled individuals such in my case, but then to have lawyers and judges ignore them and not apply them? I am told by legal malpractice lawyers that I have a good case, and the case is time sensitive(thanks to lawyer 2) but the case has been complicated by these 2 lawyers that I cannot find a law firm with enough resources to handle such a case. Where is justice? What good is a legal system? These lawyers knew what they were doing to me all the time! Is there no ethics in the legal profession anymore? The 100,000.00 of equity was gained due to someone's negligence in 1980. I had a right to that because of the life I had taken away from me because of their negligence. I am in that same situation today. I guess that fact that a negligent man who wasn't paying attention on the job and accidentally disables his co worker, is worth more than a negligent lawyer who purposely destroys a disabled mans life! AND NOW I GET NOTHING!!!! SHE IS ALLOWED TO KEEP IT ALL BECAUSE OF THEIR ACTIONS! ----------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------- The worst thing about this is, I have kept the documentation proving the malpractice, in black and white. These lawyers prove my case by their own hand! The fact of the lifestyle I am forced to live, and all the debts from the divorce are what I still have to deal with every day. I thank God that I live is the US for my monthly disability check. I regret that we live in a society that could care less about someone disabled unless they were thrown out of a wheel chair, and only because it was available on video tape! I'm sure the lawyers lined up at their doorstep to take the case! I can not understand why our government works so hard to put such laws in place to protect the disabled, and there is no recourse when they are ignored, other than for the rich!?! ----------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------- I am 50 years old, and have had to live with this injustice for 10 years now, I have lived with my disability for 28 years which is much more loss than a measly $50,000.00-100,000.00 personal property loss from these lawyers negligence. The fact of having to learn that there is no-one that truly cares what happens to someone that is disabled unless there is big money, and easy big money. I have been told by law firms that my case is so complicated by these 2 lawyers, and now time is a issue because of lawyer 2 actions, That mine is a good case, and they believe there is negligence, but no-one will take it. ======================================================================================================================================================================================================================================================== I am sorry that I have to write such a negative blog today. I write my blogs from the heart. I am told by my brothers and sisters to go on, give up and get on with my life and get over it. But I didn't see my Chiropractic DR. brother and sister-in law forget it and "just go on with their life" when a company took advantage of them? I guess I am confused, angry, disappointed, and hurt because I believed people were good, and did the right thing because it means something to them. I am finding out that no-one really cares unless there is a pot of gold at the other end, and gained without effort.============================================================================================================================================================================================================================================================== When I was 100% paralyzed, and lying in a hospital bed having a respirator do my breathing, I did not give up! I would not be where I am today if I had! Many times I wish I had entered the court room in a wheel chair, because by walking into the court room kept my disability hidden from the courts, and that is why I am in this mess today! ================================================================================================================================================================================================================================================================== I guess the real truth in my post is that I have to learn that being disabled means you are less of everything. You have to learn that you will live with people taking advantage of your disability all of your life. My disability is more mental than physical, TBI so I am an easy target. people just think I am stupid, because I have short term memory loss, They do not realize short term and long term memory are two different worlds, I even had this question asked to me by both lawyers, one in writing?!? How can you remember all these things if you have a memory disability?? Now who really is the ignorant one here?? ========================================================================================================================================================================================================================================================================= I have really lost faith in my fellow man, Maybe I just care too much about always doing right, and good, by what the big boss has written in his "life manual", I have always done onto others as I wish to be done to me, but I always end up turning the other cheek over it. I can only be happy that they haven't nailed my butt to a cross yet! I have lost faith in my fellow man, but I have not lost my faith. If I lost my faith, I would not be able to scream because of such injustices, I would have "checked out" a long time ago. =========================================================================================================================================================================================================================================================================== I write these bogs/journal and posts for me. I also write them for the same reason I read others and say to myself, thank God I am not in their shoes. When I start writing each blog I have no idea of what I am really going to put in them, I just start writing, and the words just seem to come so easily, and before I know it, I have written pages... I guess that is what happens when you write from the heart. ================================================================================================================================================================================================================================================================================================================================================== This is a copy of letter sent to lawyers trying to hire one to straighten out this nightmare they have made of my life. I have discovered no one will take the case because it is so challenging, not because it cannot be won! I have been told it is a legitimate case, and on top of it all, I I have been informed by a firm, now there is a time issue! That is was lawyer 2's main objective, so obvious now. =============================================================================================================================================================================================================================================================================================================================================== To whom it may concern: ====================================================================================================== I am a disabled man living with TBI since 1980, who has been discriminated and taken advantage of by 2 law firms. Lawyer 1, the lawyer who miss-represented me in the actual divorce hearing, 1999, which resulted in losing all my rightful property, and a 100% disabled father having to pay $350.00 a month for 8 years, child support payments when my total monthly income was barely above $400.00, due to my decreased earning ability, total in the tens of thousands My brother, Dr.(private), and I informed lawyer 1 of my severe disability and I offered medical records if needed. Lawyer 1, never asked for my medical records, made no mention in court of my severe disability, he made no mention of the fact the house was paid for in cash, by lawsuit disability settlement in 198X injury, 78,000.00. He also made no mention of property brought to the marriage by one spouse. My $80,000.00 plus, house was given to spouse, my $20,000.00 personal property was never given to me, my wages garnished until 3-2008 wrongful child support levy, and no property listed in divorce was ever given to me, as per agreement. The agreement was formed upon inaccurate figures, undisclosed assets and debts, because Ex-wife managed all finances due to my TBI, I had no way of knowing at the time. I now possess all the correct figures, which is quite a substantial difference, a difference of 40-60K minimum. plus interest, other than the incorrect figure of 12K. Lawyer 1 did not even disclose my severe hidden disability to the court at time of divorce. ============================================================================================================================================================================================================================================================ I became 100% disabled, 4-2001 as per SSDI documentation. ========================================================================================================================================================================================================================================================================= The other lawyer that took advantage of my disability was Lawyer 2. I hired this firm approximately 2 years ago, (and at the start of the divorce, 1999 they dropped my case because I was not able to access my assets to retain them) to address the above issues to settle an open divorce case because my youngest child had reached 18. Lawyer 2 informed me that the above case was closed and I would have to re-open the case to dispute her incorrect figures, which I did not discover until studying the final settlement agreement, the case was an open case and he was lying to me. This lawyer was negligent by putting harmful verbiages, as requested by ex-wife into settlement against my best interests, and not informing me what the changes were, and neglecting to include rightful interest due to me, stated by courts. After 2+ years of phone calls, email, making a court date for hearing, only to remove it, and attempt to settle out of court, I found I was not even fighting another lawyer through all of this! She had no lawyer, and this firm was sharing all my private documentation, and information with her! I was fighting my own lawyer!? I did not agree to his settlement offer to her, and fired him realizing only then, what he has been doing to me all these years! Because of my TBI, I am very slow to discover when I am being taken advantage of. I have to trust, because of TBI, until proven wrong. ============================================================================================================================================================================================================================================================================================================ I have documented proof of every word stated in this letter per documents, and e-mail. The proof is very obvious in the documentation I have in my possession. Both of these lawyers have proven themselves negligent by their own hand and documented results. I am only asking that someone with a desire to correct this injustice done to me and allow my life to continue as it should have as written in State statutes because none of these laws were followed in my divorce case, Why are these laws written? Are these laws to be applied to only the rich? I thought these laws were put in place to protect the disabled such as I? It seems like a waste of time making laws and not enforcing them to protect people like me. ============================================================================================================================================================================================================================================================================ I know there are good lawyers who care about their clients rights and doing what is right for them. I am seeking this lawyer now. Someone to represent this TBI survivor, These two law firms have destroyed my quality of living, and my life, as I still to this day, have to deal with the financial disasters they have created for me. Dear Michael.......I certainly feel the anguish in your post.......and understandably........you feel that you were taken advantage of.....and used because of your short term memory disability. I could be wrong.......but I don't think anyone here at disaboom can legally help you..............what I really think you need to do.......if at all posssible......is move forward with your life........just giving over to God......all the injustice you feel............can you imagine when our dear Lord was being judged by the courts.......what they said against Him........and how he said nothing back ?......I think he was trying to show us that looking for justice in this world.......is useless.........just to give it up......and over....to Him......I think your life will have more peace and comfort in it if you can manage it........don't think for a second that it will be easy.......but if you ask for our Lords help......you'll get it.......it could be the beginning of a more grounded......peaceful life for yourself......I do hope you can do it.............my prayers will be with you..............peace and love......Norma

Norma's right...you're not likely to find a lawyer this way but you can find some support and hopefully look around and get some enjoyment out of our community. I understand why you don't want sympathy. I think it's a close cousin to pity and it makes me feel uncomfortable too but we all need and crave EMPATHY-where people can relate and think about what it must feel like to be you right now. Michael I have never had a divorce or dealt with children or child support so it's not wise for me to offer advice. I do know though that you are not less then because you are disabled.  I'm sorry you were taken advantage of and it's been so many years.  I do know that from what you wrote, you are a fighter and you've yet to give up on trying to fight whats wrong so things can be made right.
